Welcome to Airachne. By accessing or using our website and services (the “Services”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, Cookies Policy, and Disclaimer, as well as all applicable laws and regulations. If you do not agree, you may not access or use our Services.
2. Description of Service
Airachne provides an AI-driven platform where users can pre-register, interact with AI Twin technology, and participate in community programs (including rewards, referrals, and AIR utility token-related activities).
- The pre-registration program allows users to secure early access and potentially receive AIR utility tokens or membership points in the future.
- AIR is strictly a utility token and membership point system, not equity, securities, or investment contracts.
3. Pre-Registration & Rewards
3.1 The pre-registration program enables early users to participate in community growth and potentially receive AIR allocations when the platform officially launches.
3.2 At pre-registration, AIR tokens have no guaranteed monetary value, real-world value, or utility.
3.3 We make no guarantees regarding:
- The future existence, value, or transferability of AIR tokens.
- The launch timeline of the Airachne platform.
- The continuation of the pre-registration or rewards program.
- The actual distribution of tokens.
3.4 Any token distribution will be subject to the platform’s official launch and further terms, conditions, and legal requirements.
4. User Conduct
4.1 Users may earn potential allocations by referring others.
4.2 Referral allocations have no guaranteed value and are subject to change.
4.3 Prohibited practices include:
- Automated or bot-generated referrals.
- Multiple self-created accounts.
- Spamming or deceptive practices.
- Misrepresentation of the program.
4.4 We reserve the right to modify or terminate the referral program and to invalidate fraudulent referrals.
5. Eligibility
5.1. You must be at least 18 years old or the age of majority in your jurisdiction.
5.2. You warrant you have the legal capacity to enter into these Terms.
5.3. Our Services are not available in jurisdictions where:
- Crypto token activity is prohibited.
- Participation would violate sanctions.
- Licensing/registration is required but not held by Airachne.
6. Accounts
6.1. Participation may require an account via social login or wallet connection.
6.2. You are responsible for maintaining account confidentiality.
6.3. You agree to:
- Provide accurate information.
- Update information as needed.
- Immediately notify us of unauthorized access.
- Not share credentials with third parties.
7. User Conduct
You agree not to:
- Use Services for unlawful purposes.
- Violate laws, rights, or community standards.
- Interfere with or disrupt Services.
- Access Services through bots or automation.
- Provide false information or impersonate others.
- Attempt fraud, hacking, or market manipulation.
8. Intellectual Property
8.1. All content (including the Airachne and Aithena characters, code, text, graphics, and logos) belongs to Airachne or licensors.
8.2. You are granted a limited, non-exclusive, revocable license to use the Services.
8.3. You may not copy, modify, distribute, or exploit platform content without prior written consent.
9. Disclaimers & Risks
9.1. No Financial Advice: Nothing on the platform is investment or financial advice.
9.2. No Guarantees: We do not guarantee outcomes, token value, or platform performance.
9.3. Regulatory Risks: Future regulations may affect Services or AIR tokens.
9.4. Technological Risks: Blockchain and AI systems may have vulnerabilities, downtime, or cyberattack risks.
10. Limitation of Liability
To the maximum extent permitted by law:
- Airachne is not liable for indirect or consequential damages (loss of funds, profits, goodwill, or data).
- Total liability shall not exceed the amount you paid (if any) to use the Services.
11. Indemnification
You agree to indemnify and hold harmless Airachne, its officers, employees, and affiliates against claims arising from your use of the Services or violation of these Terms.
12. Modifications
We may update these Terms at any time. Continued use of Services after changes constitutes acceptance of the new Terms.
13. Termination
We may suspend or terminate your account at our discretion for any reason, including violation of these Terms. Certain provisions (intellectual property, disclaimers, liability limits) survive termination.
14. Governing Law & Dispute Resolution
14.1. These Terms are governed by and construed under the laws of Hong Kong Special Administrative Region (HKSAR), without regard to conflict of law rules.
14.2. Any dispute arising from or relating to these Terms shall be resolved by binding arbitration administered by the Hong Kong International Arbitration Centre (HKIAC), under its rules in effect at the time.
14.3. The arbitration shall be conducted in Hong Kong, in the English language, by a single arbitrator appointed in accordance with HKIAC rules.
14.4. To the extent permitted by law, you waive any right to jury trial or participation in class actions.
15. Miscellaneous
- Entire Agreement: These Terms + Privacy Policy = full agreement.
- Severability: Invalid terms will not affect the remainder.
- Waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign rights; we may assign freely.
- Force Majeure: We are not liable for events outside our control.
